Medical Malpractice

The term "medical malpractice" refers to a failure by a physician and/or medical personnel to meet the customary standards of care in the diagnosis and treatment of a patient, and as a direct result of that failure, causing a patient to suffer disease or injuries that he or she would not otherwise have incurred. Medical malpractice is often referred to as "medical negligence", which is likewise a failure in the duty to use reasonable care given the patient's circumstances, or a failure in the duty to have the knowledge or skill required to provide adequate medical care.
