Injured workers often ask about whether their claims are still open for medical treatment.
Likewise, providers are often concerned with whether their bills are timely filed and when bills are payable in a claim.
Under the law, Ohio workers’ compensation claims remain open for payment of compensation and medical bills for a rolling 5 year period from the date of the last time compensation or a medical bill was paid. Thus, if an injured worker periodically is seen for medical purposes under the claim, a claim can stay open indefinitely.
There is a CAVEAT to this rule. For claims arising prior to August 25,2006, the rolling period is 10 years from the date of last payment of compensation and 6 years from the date of last payment of a medical bill. The reason for this difference is because the law was changed as of August 25, 2006, to shorten the period for which a claim can remain open and under Ohio law changes apply only to claims arising on and after the change in the law.
Thus, the date of a claim will dictate how long that claim can remain open.
The law also requires that bills be submitted within 1 year of the date of service. Bills submitted after 1 year has elapsed cannot be paid and the provider is not allowed to bill the injured worker for such services.
Once bills are submitted, the bill will be paid once there is either a final order allowing the claim or, if disputed, when the allowance of the claim has been affirmed on the initial appeal.
