Social Security Disability Eligibility

To qualify for Social Security Disability (SSD) benefits, you must meet the government’s standards for physical or mental incompleteness.  The SSD administration has a definition for the term disability, as it does for most words related to claims.   An Ohio SSD attorney can help make sure that your case meets the government’s requirements and that you receive the benefits you deserve.

When an Ohio social security disability attorney examines your case, the initial inquiry focuses on your eligibility. The government has developed a five-point test to apply to your situation.

  • Are you working? If you have any sort of income, you may be ineligible for unemployment benefits or severance pay. Likewise, if you earned more than $1,040 per month, you are ineligible for disability benefits.
  • Is your condition severe? In other words, does your disability interfere with your normal work activities? A broken leg may have little effect on a writer but that same injury will probably sideline a construction worker.
  • Is your condition on the list of disabling conditions? Some disabilities are so bad that the government deems you disabled without asking more questions. Otherwise, the severity of your disability is an issue.
  • Can you perform the work you performed previously? Is your disability such that you are physically or mentally unable to continue in your former career? Can you perform any other type of work? Your days as a heart surgeon may be over, but are there other ways you can secure gainful employment?

Giving the incorrect answer to any of these questions can lead to the denial of your claim. An experienced Ohio SSD attorney works to develop the strongest claim possible on your behalf.
